    Will I get booted from my apartment?

    I am just moving into an apartment and have not filed yet. Every apt application has asked if I have had a bankruptcy in the past 7 years. I have not ... yet.

    It probably is a bit different in the various apt complexes, but do you think they will ask me to leave if they find out that I have filed?

    No. You'd have your own cause to action if they tried to evict you because you'd filed bk. Just stay current on the rent.

        On an opposite note, is it really THAT HARD to rent an apt if you do have to disclose that you had filed bk?

          A lot of complex's won't rent to you if you have filed BK - you know the ole routine - your someone that doesn't pay their bills...... they don't want to take that chance, cause they know they can't put you out during the BK process.....

          Since you haven't filed yet, should be no problem, if their is - they have no grounds to put you out as long as your rent is current...

            The other person who told you once you move in the place, do not ever miss your rent is so very correct. I am living in a very nice apartment complex. When I first moved here 7 years ago, I had excellent credit. Since filing bankruptcy, I have made extra sure that the money for the rent is always avaliable to run to currency exchange and get a money order to send it in on time.

            I also agree with the other person who posted that large rental agencies do not want to take the chance on renting to you if you filed because they know they will not be able to throw you out and they lose money doing this. Better to stay there for a very long time than to take that chance. I even called my apartment complex to see what happens and they told me that even if you wanted to move to another apartment in the same complex, you do not have to pay another security deposit, but they run your credit history again....now we really do not want that.

              Some apartment` complexes -- through a management service - will run a credit report on you, and can turn down your application to rent/move in.

                Two things we were told by Management agencies when we were relocating to CA last year were,

                We needed to be at least 2 years post BK and/or have a credit score of 620 or higher.

                  I haven't found it to be a problem. However, I've always paid the rent (w/exception of moving out early due to bad apt. mgt. & a better place to live...did not pay last mo. rent & let them keep deposit).

                  I did let them know of my bk & I'm sure they ran a check....
                  I did tell my present landlord but he's had no problem with it.

                  I'm sure it just depends.
