    Trying to surrender car

    I called the bank yesterday, and they put in the request for someone to come pick up the car today. Well, I come home from work and it's still here. So, I call the bank today and they refer me to someone that handles the reposessions. I left her a message... I stated that I was in process of ch 7 bk, filed intention to surrender the car, and want the bank to come get it.

    There is a hearing next Friday to lift the stay.
    Do I need to file anything with the court or submit a statement in regards to my wanting/trying to surrender the car?

    The bank said that if the stay is lifted, it is considered a repossession and will affect my credit negatively.

    But I thought that during a bk case, if the car is surrendered OR stay is lifted and repo'd that it doesn't affect your credit report. Nor can it count against you if after the bk is discharged, and later down the road, you want to finance a car.

    Should I contact the bk court and/or the trustee? A copy of the motion was also sent to the trustee.

    That is a lie the bank lies to scare you ! you put you intend to surrender on the schedules. They HAVE to have the stay lifyted to LEGALLY pick up the car even though you said come and get it. Once they do get it it is included in bk and they must report it to you credit that way if they dont then dispute it on the credit report and it will get fixed.
    Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

      See, that's what I thought, too... that they need the lift in order to collect the car I am surrendering.
      But I will call the trustee and clerk tomorrow to be 100% sure!.

        Yep just scaring you. Call your trustee/clerk tomorrow and I'm sure they'll tell you the same. They can't legally come and take the vehicle until the stay is granted.
