Hi Todd, I have 2 mortgages on my home and both foreclosed on the property when I lost my job. The first worked out with me but while that was going on the second bought the property in a Sheriff's sale. Should I continue paying the first, because the second wants to evict me from the property as of October 1st.? Can I sue either mortgage company for having playing tog of war with me? What recourse do I have to keep my home?

I don't know if I quite understand your entire question. So I'll answer the parts I do understand. My question to you is, do you intend on filing for either BK7 or 13? or do you simply intend on letting your mortgages forclose? You can sue the mortgage company if you'd like, but you'd probably be better off using that money toward attempting to keeping your house. Depeding on the state you reside in, you can explore options in keeping your home under a Chp 13 or Chp 7. Which one you should depends on several different factors, .e.g. income, state laws, equities, assets et cetera. Whether or not you should continue paying on the first mortgage depends on what you want to do.

now this is interesting. you loose your job. im sure you was
foreclosed by law, now you want to sue? that is what
happens when a person over extends, then wants to blame
someone else for their problems.

Umm, if the house was already sold at Sheriff's sale, how are you still living in the house. Who exactly has title to the house now?

About the only thing you can do is file a Chap 13 to try to recover the property, assuming you can bring arears current, otherwise, It might be too late.
