    Per Danaf's suggestion, I wanted to post my means test calculator

    results up here and see if I could get some input. I've got different attorney's telling me Ch 13 and Ch.7 as I'm pretty close to the cut off. I'd obviously like to go for Ch.7 if it's an option for me, but I don't want to file 7 and be SOL if there's not a chance that the court will accept it.

    This free online calculator computes your means tests results, applying applicable local standards for Washoe County Nevada, as required by federal law. The 2005 bankruptcy law (BAPCPA) requires all persons to complete a means test (Official form B122A) before filing for bankruptcy. It requires no registration or disclosure of personal information. In 20 minutes you can find out whether you qualify for Chapter 7 bankruptcy under the Federal Bankruptcy Means Test. (Bankruptcy Code 11 USC. 707(b)(2)).

    My suggestion is to try to find an attorney who is also one of the local bk trustees in your area. If this is not possible, then keep asking the attorneys. If you are close, someone will be creative enough to get it done for you...........

      you pass the means test so I'm not sure why lawyers are trying to push you into a 13.

      do your real expenses closely mirror the means test?

        I hate to say this but a lot of lawyers are pushing people into chpt 13 with no regards to the means test results. I say keep looking for the lawyer that will put you into a chpt 7 if you pass.
        Success is reachable, stretch out your arm and grab it.

          Why are some of the lawyers telling you that you have to file Ch 13? Have they completed the Means Test with all your financial information? Or are they going just on your income for the last six months?

            My last good month was July and income has been going down since. I'm putting in income numbers that are based on the assumption that I'll be filing in Dec. and take June-Nov. #'s. I can pretty accurate estimate Sept. income as I have my sales #'s for Aug. and I'm just taking average of Aug. and Sept. income to estimate Oct. and Nov. income. Based on my historical income it should be accurate +/- $500.

            First two attorneys didn't even want to look at the Means test, just told them rough gross monthly income numbers, and they said definite Ch. 13 from there. It was only the third who went through and plugged in the numbers and told me he could get us Ch. 7. It sounds like, from other folks stories, that the first two attys. were just trying to earn extra fees.

            One more atty. meeting scheduled tomorrow so we'll see.

            Also, did an internet search on trustees here and there are two for the Ch. 7 BK court in our Co., but I can't find any info that would indicate that they also are practicing attorneys. Is it common for Trustee to also represent BK clients? Seems like a conflict of interest, but what do I know?
