    Extend time to object issued before discharge?

    Ok so I log into pace and see this:

    "Stipulation and Order by and between Debtor "me", "Trustee" To Extend Time To Object to Exemptions until 05/23/05 (mlaf) [EOD 03/30/05] "

    The curious part is that it is issued before the discharge(5-11-05)....does this mean the discharge will continue to be valid unless someone objects before 5-25-05?

    Bite-ing Nails.....sigh

    Did you actually receive a discharge notice in the mail? This sounds odd to me. Well your date should have expired today, have any objections come up? Hope everything went well for you.

      One thing you need to know is that a Discharge does not END your bankruptcy case. Its an administrative entry by the Bankruptcy Clerk, so you should still get your discharge on time. What the trustee is doing is taking a careful look at the way you listed assets and the corresponding exemptions.

        yes indeed they are...information was requested about my 401k...its ERISA status was questioned (however all 401k plans are ERISA from what i am told). Turns out the trustee for some reason thinks some 401k's are NOT ERISA compliant. Mine is, however, the trustee(pushing the issue) has extended 30 days and is requireing full disclousure from the plan manager. yes i received the discharge in the mail...but i suspect it means nothing.

        Strange..I was contributing 4%...as it was matched. I suspect they will request i pay all monies contributed over the last year somehow?

          ok...Now I am confused. The trustee has sent a supiena to my boss with regards to my 401k and he is being directed to appear in court. I dont understand...sigh.
