Stopping automatic payments for checking acct.

Anyone have any problems with creditors still trying to take monthly payment AFTER you send them notice to remove your account from autopay? I called a creditor today and requested that they stop taking an automatic payment out of my checking acct. because I was closing the account (i am current and didn't want them to know that I'm filing BK just yet). Just wondering if I will have trouble with them stoping automatic debit payments and if once they realize that I'm not going to be paying them anymore are they allowed to start it back up again even though I told them to stop. Maybe I should get a new checking with the same bank.

perhaps you should stop the ACH with your bank/credit union. It might cost 25.00 stop payment fee but would be worth the peace of mind. If they continue to take money out of your account after you deauthorize it, I believe you have a legal case against them.

If they do start up again, you should be able to dispute it with your bank as unauthorized. Some banks even replace your money in good faith before their investigation into the debit is even complete.

DO NOT get another checking account with the same bank. Go to a completely different bank. That same bank will hit your new account with the auto withdrawal, names, social security #s remain in their system. Banks conspire with each other to keep themselves profitable by screwing customers over.
