    Finally got moms credit report

    Hello, Well since my last post I have met with three attorneys,and got moms credit report.

    All of the attorneys said they would have to ask the trustee if I could file for her. There answers were the same NO. The trustee says I must have guardianship.

    Now the credit report, unbelievable. Experian has my full name and address on her file. They also have her listed as diseased. I contacted Experian and explained the situation and asked them to correct this. They said mom would have to contact them, as it is her credit file. I explained again that she is not able to handle this as she has alzheimers, and that I have POA stating that I am the one that handles ALL of her affairs.Then they say if I send them copies of the poa they would note after my name poa, but they would not remove my name from her file. They said Social Security is where they got the diseased from and I would have to contact them to correct it.I know this is wrong as she still gets SS.

    Does anyone know who to contact,or an easy way to resolve this? I want my name OFF of her file.

    YOU don't have to prove anything to the credit reporting agenies (CRA). THEY must investigate incorrect information and correct it.

    Write a letter, on your mom's letterhead (easy to create on the computer), citing each error you find on her report. You don't have to tell them what the correct info is - just that what they are reporting is not correct.

    Sign it as her POA. Send it certified, return receipt requested. They have 30 days fro teh date they receive it to investigate and make corrections, or they must delete the disputed info.

    CRA's will try almost anything to not have to comply with these laws, so be prepared to remind them that this is the law, and you do expect compliance. If they fail to properly investigate (which means contacting the original source of the info, not just checking their own records!) and correct within 30 days, they can be held liable to your mom for $1000 per violation.
