If i understand right, you have to attend a 341 meeting, but whats the confirmation? Is that with the judge and do you definetely have to face the judge? Sorry, but i'm really afraid of that part of it. I do have to file though, but waiting 6 months due to a 5000 cash advance from gambling and very embarrasses by it.. Thanks for all the help...

Ch 13 has both a 341 meeting and a confirmation hearing. The 341 is the only time you are required to be in court.Originally posted by helpsoneeded View PostIf i understand right, you have to attend a 341 meeting, but whats the confirmation? The confirmation hearing is when your Ch 13 plan is officially confirmed by your trustee and the court. It's attended only by your lawyer. You do not have to attend.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
06/01/06 - Filed Ch 13
06/28/06 - 341 Meeting
07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
08/10/11 - DISCHARGED !
10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go

You will never see the judge unless your case gets objections from the trustee or creditors that can't be worked out by your lawyer. The chances of getting an objection is very small. The chances that you get an objection that can't be worked out by your lawyer is even smaller.Originally posted by helpsoneeded View PostThen where does the judge come in? Sorry, just nervous about that part.
We actually did have to go before our bk court judge for a special hearing because we're a test case for our district in two Ch 13 areas. Our lawyer did all the talking - we just said our names at the start and thank you at the end.
The chances of you ever seeing the judge is so close to zero, it won't even register on the worry scale!

Depends on your district. I met with trustee one on one and then aprox. 30 days later had to return to court with about 150 other people that had filed a 13. We had to listen to a 45 minute lecture from judge mainly about our bad money decisions and what would happen if we didn't make our payments on time. Then he called our name, signed our conf. order and sent us on our way.Last edited by gunsmoke; 09-13-2007, 07:11 PM.
