    Can they file???

    Can two unrelated people (not officially married to each other) but sharing an apartment,( in other words shacking up) file separately, if each has their own bills, nothing joint, if they do not consult the same lawyer? Do the courts cross reference addresses of people filing?

    Yes. The bk trustee would consider it 2 separate filings; i.e. 2 single people filing bk. I don't believe you can file joint if you are not married.

    Correct me anyone if I am wrong.

      Yes, the 2 BK's would be seperate, and I doubt there woudl be any cross referencing. You cannot file jointly. Only married couples can file joint BK's.

      However, for example, if you share expenses, you each cannot claim the FULL amount of that expense on your respective BK forms. (at least not w/o committing perjury). So if you two share the rent payment 50/50, and rent is $1000 per month, you can only claim $500 of that as your "rent expense".
