    Bank of America Problems

    We filed on 3/16 and had our 341 on 5/11.

    All of our accounts have 'left us alone' with one exception, BoA. They have continued to send bills with late fees and past due notices. Today we got a letter from them telling us to protect out credit report and make our payment "to avoid any further collection proceedings". They were included in our BK.

    The card we had was a Fleet Visa that BoA bought out. They BK letter still went to BoA though.

    I have kept copies off all they bills and such, just in case we need them. Do I just send a copy of the BK letter to them with the latest bill or how do I get them to back off?

    Are you sure they know? We had a creditor continue to call us and offer us a new loan for heaven's sake. I asked the person that called the last time if they were aware of the BK filing and she said no. Hard to believe given the info is in the computer but regardless sometimes things fall through the cracks. I would make sure with your attorney that they did indeed get a copy. Doesnt make any sense why they would keep calling if they knew.

      They got a letter and were included. It probably got lost in the shuffle as they had just taken over out Fleet account.

      I just sent a copy of the letter to them. Sound right?

        Good idea and if they have any problems with the letter they can/should consult your attorney.

          Now they have started emailing. I mailed the letter yesterday, but decided to call today. Gave them the case number and the contact info for my lawyer and told them they are in violation of the automatic stay and that I have forwarded all the of the info and threats to my lawyer. Hope they back off now.

          Funny thing is, they used to call prior to our filing. Not a phone call since. I think they are playing dumb, hoping they can squeeze a little more $$ out of us.

          The more I read about Bank of America, the more they tick me off. Plus, I read an article that they were going to or did file chapter 7 around March...then they ***** at us?? Freaking hypocrites!!!

            Once they get notification of your bankruptcy, and they still continue to send notices, they are in violation of Bankruptcy laws, and can be held accountable!

              I told them that and that they got a registered letter mailed 3/16. I have a funny feeling that they are playing games. I have everything they have sent me and so will my lawyer. If they wanna play games...I will play too.

                Leave the game playing to kids, focus your efforts on ensuring this particular creditor accurately reports your account as having a -Zero Balance- (Chp7 BK) on all three CRA's.

                  I have done what I needed to do, now it is time to look ahead and work on the future. It is easy to lose track of what matters when I get frustrated.

                    You could sue them for violating the law too. I have read of several cases where the company still sending notices and such have had to pay BIG TIME.
