    calls from creditors

    yes, i have a question, i been late on payments to cc companies going on 4 months and plan to file nov.2007 or dec.2007 the phone rings off the hook i let answer machine answer them. the question i have would it help to stop calls if send a letter to each cc company that i plan on filing bk in the very near future, would it help, and would be considered fraud by sending the letter

    Don't waste your time telling your creditors on the phone or by letter that you are planning to file bk. They hear this day in and day out.

    What may help is to send a "cease and desist" letter telling your creditors that they are only allowed to contact you in writing and only if there is a change in your account (they sell it to a collector, for example). This works sometimes to at least decrease the call volume. There are examples and links to online examples in our forum Sample Letter and Forms area. Good luck!

        In most states, and under the FDCPA, the "cease and desist" only applies to debt collectors. However, I suppose if you send such letters to creditors, they might realize you are not worth the trouble. I'm getting several "unknown" or "private" calls these days, but I simply ignore them. If a number does come through and it is not traceable in a reverse phone number lookup, I ignore these also. To each their own.

          Put THEM on hold for once...

          Hey,

          The cease/desist letters really work. If / when they don't, you can sue the collectors in small claims court. Several members of this forum have sued debt collectors for $1000+, due to violations of the Federal laws involved.

          No need to give them any information regarding your plans. I'm sure there's a template for the c/d letter somewhere on this site.

          Many times when they call me I just put them on hold, while playing weird music. The stranger the music, the longer they hold / try to yell / etc. Music or not, it's amazing how long some BCs will stay on the line, to no avail.
