    clueless, where to start

    After reading some of the posts here, I'm clueless where to start with our problems.

    Should we try to negotiate with credit card companies ourselves before seeking a lawyer? If so, what do you say to cc company? We really have a lot of debt on 2 major cards and some other debt that adds up. If you negotiate with the cc companies, does it go on your credit report?

    Should we try a non-profit credit counseling? We talked to one locally who couldn't help since we had not missed any payments.

    Should we talk to BK lawyer first?

    Talk to lawyer. If you are not in default on your credit card payments, your credit card companies won't give you the time of day in negotiations. As a general matter, its a waste of time to negotiate with the credit card companies.

      If it's what you really want to do, then call the CC companies, tell them unless you can reach some agreement, you will have no choice but to file bankruptcy. It can't hurt, although reading on this board it doesn't seem they are willing to work unless you're already behind. *But*...what can it hurt to try? Be point blank, if the person answering doesn't seem willing to work with you then ask for a supervisor. I'd just make it VERY clear that you have no problem filing bankruptcy and you're giving them a chance to get at least a percentage of the balance. Who knows, maybe you'll get somewhere.

        Also if you talk with someone in authority with the cc company be sure and get the agreement in writing. So often these "deals" are made and the cc company denies ever making them. It sure can't hurt but dont be surprised if they won't.
