    third party collection AFTER 341..dirtbags!

    I had one particular hospital bill that was sent over to NCO. They tried to collect for about a year before I filed in August. I included NCO and the hospital in my chapter 7. It seesm NCO sold it now to another collector. They sent me a letter saying if I did not respond it 30 days it would 'verify' the debt. Do I have to respond to these trolls???
    I hope they rot in the wrath of the hospital debt hell.

    Send them a letter - give them the date of your filing. Tell them that that account was included in your petition.

      I doubt they're trolls. Depending on when they bought the old debt they may have no knowledge that you filed. They're just doing their job of trying to collect. Send them the case info and be done with them.

        One thing I can say about the messages I've had on my voicemail from NCO, there has been a thank you at the end of every message so far. I don't get that very often.
        I'm still not talking to them though.

          Call them or send them a letter.

          Tell them you filed BK, the date of filing, Chapter filed, and Case #.

          That should be the end of it for hearing from them.

            Send it certified mail return receipt requested so you have proof. Any further collections after that, actually after your filing, is a violation of the automatic stay of bankruptcy and they can be fined - you getting some money (possibly) out of the deal.

            Start a paper trail.
            Chapter 13 Filed "Old Law"
            Filed: 6/2003 Confirmed: 3/2004
            Early pay off sent: 10/05/2007 - 9 months early
            11/16/2007 - Discharged!

              I sent the letter today with all info. Its funny, my lawyer seems to get excited when these third party guys come out of the woodwork. Chance to make money I guess.
              Thanks for that advice, many of you are very helpful ten times over. A paper trail is very important in case they keep it up.
              I still think its "troll-ish" to sell in account in while in active BK because you know you can't collect on it anymore. Its even more nasty to buy it. It ought to be illegal, and enforced. Oh well, I suppose it creates jobs...
