    Those who feel bad about filing on banks should have a new found outlook after reading that peice.

      I'd have found another mortgage company.
      One thing I did after my bk was discharged and closed was to print the page of pacer showing the list of creditors who had been notified by the court of my discharge. I just looked and on mine, Cap1 was noticed electronically-even has the exact hour and minute of the transmission.
      It just seems like it would be so easy to sue Cap1 for false credit reporting and force an IIB designation. I doubt they can argue with the DOJ as to if they were notified.

        how do you find the list of creditors notified of your discharge???

          It was the last or next to last entry on my file. It's from the Bankruptcy Noticing Center.

            OMG!

            What it shows me is how very important it is, after discharge, to continually monitor your credit record and immediately dispute any inaccuracies.

              I think most of us suspected this, but it's very troubling to actually see it in print, as a fact.

              A must-read article!

              BK 7 filed and discharged in 2004 after 30+ years of perfect credit. Life HAPPENS.

                  I merged the 2 threads, as they both noted the same article, and moved them to this Section.

                  Long, Long ago, on the BK Forum, far, far away,......... There was a thread about Zombie Debt Collectors. Much the same information was being printed 18 months ago.

                      I sometimes get debt collection calls about an account from 23 years ago. It's not even my account, I was only 16 years old. I was puzzled as to why they'd be trying to collect after that amount of time and after researching, it was a zombie collector.

                      Even though we are basically judgement proof, one of the reasons for wanting to file was because of these zombies! I don't want people calling for 50 years about these debts.

                          Interesting, but frightening article. If I ever get hassled about a discharged debt, will just make a copy of my petition, listing of the creditors, the discharge document. Will also put my fist with my middle finger out on a copy machine, copy it and send it along with the others.

                            This happened to my parents.
                            They filed in the late 80's and right after their divorce in 94, they were suddenly being sued for an old credit card that they had BK'ed years before....

                            I am saddened to see (and frightened!!) that this is STILL happening!

                            On the other hand, it would be fantastic to be able to take those suckers to court and win a large settlement for their violation of the law!
                            BUSY running my own credit repair services! Sorry I don't stop in so often any more!

                              hmmm
                              They know we can't afford attorneys. hard enough going thru the trauma once. they will stab with butcher knives as the general public goes thru life not knowing or giving a hoot what is really happening from sea to shining sea, of course, until it finally hits real close to home- then the rules change.
