    Should your lawyer discuss things with you before your 341?

    Hello folks, thanks for all of your help. As the time for your 341 meeting, do lawyers typically discuss things with you or does he go in the meeting with you and play it by ear? Thanks for all of your kind and terrific help.

    Your attorney may have you meet him/her there about an hour early and they will probably go over some of the questions you may be asked. Your attorney should be in the room with you during the meeting/questioning.

      My 341 is scheduled for 11/26 @ 10am....my attorney just told me to have my social security card and license...and she has everything else needed. She also said drive by the courthouse a day or 2 before the meeting so I will know the exact location...because if i miss the meeting..the case is dismissed

        This is exactly what happened with me. My lawyer met me there and took me aside to a small private room and talked with me a short while about what to expect. And of course he (figuratively) held my hand and assured me it would be ALL OVER in a VERY short time.

          also its good to go ahead of your actual meeting time(my was 30 mins behind schedule due to others in front).
          Oh, good to sit in on cases before you to get better feel of the questions the trustee ask. This really helped me and I was not nervous.. Good luck

            We Consulted with our attny and got all our BK filing questions out of the way with him. When we decided to retain him, we met with the paralegal to turn over our docs and go over our expenses and such.

            The paralegal told us then, what to expect at the 341. She looked at our list of Creditors and said, most likely, no Creditors would show. Generally only the locals show up. Then she rattled off a list of local retailers that are notorious to deal with at 341's. Didn't apply to us.

            She told us we'd sit across a desk from the Trustee. Our attny would be there. The Trustee would ask,.......... And then she went thru 10-12 standard questions to expect. She said our attny would be right there to help us out if needed.

            The day of our 341, our attny met with us briefly before hand. He went thru 3-4 key questions he knew the Trustee was gonna ask that he wanted to be sure we were aware of.

            The one "key" question I remember was "Have you read, do you understand, and did you sign the Trustee's BK Information Sheet"?? That's the information sheet that tells you about the different types of BK Chapter there are and what BK is.
