    I did it All Wrong!

    So I lost my job about a year ago, lived of savings till they ran out and cashed out 401k wich is now gone hoping I would find good work by now but I havent. So in a stupid desprate act, I have been taking cash advances to pay my car, health insurance, and other credit cards from going bad. I am at the end of my rope and now that I am considering BK I just found out I was not suppoed to do any of that. Since my credit is still good, I switched to 0% cards to by time. I filled out my info the same as alwasy still saying I worked for XYZ company. Now I realize that was more then a white lie, and I am worried it would be cosidered fraud even if they didnt bother to check. I did it all wrong

    Can I still do a BK? I read the 3 month rule is not hard and fast, only a guide line. Since I have to list them, if they contest, they will claim I purposly defrauded them by saying I was still employed. What you you do?

    First things first. Get a job-any job and get some income generated.
    The bk can wait-the longer the better. If you can delay filing as close to a year from from any credit card activity, you have a pretty decent chance of getting no creditor objections.

      I agree with Keepmine - time to get a job - any job!!!! Then wait it out just as long as you can before filing bankruptcy......

      You don't want to cause any unecessary problems when you file for bankruptcy..... especially anything that would cause your case to get dismissed..... BECAUSE then financially you have "no way out" of the situtation.....

      Get that job, pay the bills that you can - but quit using cash advances for paying your bills.....

      Get back on track where you can file bankruptcy in 6 months if you can......

        Thanks for the "get a job" advice, but I should have mentioned the reason I lost my job was because I was hurt in a car accident unrealated to the job.

        I am permantly disabled, not going to get better and qualifying decision for any kind of state help can take up to a year for a decision and it could still be declined. Been waiting for months.

        I am still able to do some work, but once they see the wheel chair and limited mobility, most interviewers freak out about disability these days and just say no thank you.

        Think about it, when was the last time anyone ever helped you in a Retail Store, Starbucks, or even McDonalds while in a wheel chair?

          Have you already applied for SSDI and it has been months since you heard? Hmmm I would be contacting Soc Security. Ususally they try to make a decision within 3 to 6 months. Considering that your situation is because of your accident, I would get yourself to an attorney asap to get free opinions on your options

            did that and it got kicked out, everyone was surprised, but long story short, I know owe even more money. It was contingency, but that only covers thier hours, since I lost, I now owe tens of thousands of dollars to both sides for misc court fees. Thier insurance company had a dozen people working on it and got the court to kick it out before trial or settlement. Lawyers thinks it was a bad decision from the judge that kicked it out, but no one will take an appeal on contingency because even if they win, all you get it the right to go to trial and they could loose again.

              That often happens with SSDI. You have to reapply, reapply, reapply until Social Security grants your disability.

              My brother was in Congestive Heart Failure. Worked long beyond when doctors told him he needed to quit. He had to apply 3 times, I think it was, before his SSDI was approved.

              I personally know of several other cases with similar results. Applied, denied. Applied, denied. Until finally,......... Applied, Approved.

              So as you work on other solutions, continue to apply for SSDI. You might just get a nice surprise the 2nd, 3rd, or 4th try, and get approved.

              Also,........... Have you tried applying for a position as a Door Greeter at Wal-Mart?? Our Wally World has a handicapped Vietnam Vet, in a wheelchair, who works as a Door Greeter. That's one for you maybe you hadn't thought of.

                It took my sister-in-law almost 6 years to get SSI. She can't work because of mental problems, which are really hard to get benefits for. My older brother had a stroke and was in real bad shape, partially paralyzed, can't speak, etc., and still took him about a year, so the system is terribly slow. He had actually recovered quite a bit by the time they finally allowed him disability, could probably work some jobs, but he and my sister-in-law both are afraid to even try to work for fear that they wouldn't be able to continue to work long-term and would then have to start the whole SSI application process again. I know they need to throughly check things out to make sure people aren't taking advantage of the system, but the waits are really absurdly long!!! Hang in there!

                  good luck......I worked the polls on election day and helped several people in wheelchairs when no one would.......some day those people may be in chairs.....doesn't take alot to be kind.......guzzie
