I have not paid my cc for a month. I would like to file BK before I get SUEd and be given JUDGEment. When do they decide to show up? BTW, I have been receiving phone calls from cc already. Looking at my monthly expenses, I can't really afford to pay them. Should I pay them less than the minimum? Will that stop them from suing me? Thanks again.

What do you mean will they show up? What would they show up to take? When we were able to pay our cc we were usually able to pay a little more than the minimum. We either paid that or didn't pay at all. I imagine they will hound you if you don't even pay the minimum. You need to consult an attorney(consult should be free) and see what your options are. Don't wait too long - the new BK law takes effect in October. -
It generally takes quite a while before a lawsuit is filed on a credit card. There are several level of collections a credit card account will go through before suit is filed. Generally, it can be 6-12 months before you get sued over a credit card. (but there are exceptions).Comment
