If you have filed bankruptcy in the past, does the trustee question you more, etc. We had to file 15 years ago because someone assumed a home loan of ours and failed to make any payments -- we had already purchased a new home and, well, I think you get the picture. Thanks

I would listen very carefully to the question, IF asked.. there is a big difference between "Have you EVER filed for BK?" and "Have you filed for BK in the last 6 years?" In either case, only answer yes or no. Do not offer any other explanation unless asked.. and then, answer only yes or no when possible. Technically, it shouldn't make any difference if you filed before, as long as it was not in the last 6 years (8 years, starting in Oct). The trustee just wants to be sure that you are eligible to file now and that if you did file just before that timeframe- what the outcome was. (ie: discharged, dismissed w/ or w/o prejudice, etc) Personally, I think they do give you a harder time, although they're not supposed to. (Everybody keeps forgetting that this is a law that was inspired by the Bible.. so much for One Nation Under God... that's for another forum, I think..lol) Try not to worry about that part of it all.. there's enough on your plate. Just be prepared, be honest and stand proud that you're doing a very responsible thing by filing. Keep remembering that we are still under the old law.. and operating under a "presumption of granting discharge to the debtor". Yes, that's changing very soon and SOME courts are already trying to enforce the new laws defacto.. it will be a sad day in October when EVERYONE that walks into that courtroom will be doing so under "the presumption of fraud". The new laws are distainful.
