    Does this have to be listed?

    DH is an electrician. We have an account at a local electrical store. We don't owe anything to them. I don't believe they are on our credit reports either. (Not that we have seen, and our lawyer didn't mention them either.) Do we have to list them? We are allowed to charge things to our account, but they are expected to be paid off within 30 days. Also, we have a budget plan for our heating oil. Right now, they owe us $300. But at $3.09/gal for oil in Vermont, our next delivery that will be more than eaten up. Do we have to list that as an asset? Essentially it is being used.

    You don't have to list any creditor with a balance of 0 on filing day.

    Assuming your heating oil is considered a utility, just make certain that you owe nothing on filing day and you don't have to list this either. Listing a utility as a creditor you owe money to on your bankruptcy is to be avoided if you can.

      Well, I don't believe we'll owe anything on filing day. Like I said, we are $300 above the water with them now, but we have a 275 gal tank. They normally come when we are down to about 1/4 of a tank. We'll have made one more payment when we file, so we'll be up to about $470 over. At that, it'll buy us 150 gals of fuel. We'll get a fill up around the end of December, which will take about 200 gals. I hope we can file soon! This atty of mine is driving me nuts. Is it normal for an attorney to hold off on having you take the be bk course until she is paid in full? Out of her fees she is supposed to be paying for our class.

        It would be unusual for an attorney to pay for something related to your case until you've paid that attorney in full to ensure the attorney will be representing you when you file your case.

        Have you discussed paying for the required pre-filing credit counseling course yourself and asking her to reduce her fee accordingly?
