    Creditors comming to your house?

    Has anyone had any experience dealing with creditors comming in person to your home to collect unsecured debts? Im just wonding what is the best way to prevent this.? It seems more invasive than the phone calls and letters people often receive.
    Thanks to all who respond during such a difficult time!

      It's not a common tactic anymore, mainly because it is costly. But it does happen.

      Legally, if the collector is a third party collector...under the FDCPA, you can send a cease and desist letter to the collection agency.

        I'm in a gated community, good luck getting in.

        I'm picky about people knowing where I live. And if it's someone uninvited knocking, I will not answer that door.

            wow, am i missing something here, dont they have to have a court order or something legal to enter your home? something like a warrant? i would think someone could seriously hurt trying to come in most peoples houses without something signed by a judge and have a police officer with them, i wouldnt think just a copy of a judgement would be sufficient, would it?

              I'm just guessing here, but maybe their thoughts are someone out there will be too scared when a creditor shows up.

              The only one I know was at my door was the HOA manager, HOA is on site. I had nothing to say to them, and they were at my door before filing. Once I filed I notified them. Then ten minutes they called me. Idiots.

                Coming to your door and trying to come in are different things. In the old days, debt collectors would come and knock on your door...and that practice is still legal. They can't come-in uninvited and that is not the purpose of them showing-up. It is just another method to attempt to make contact with the debtor.

                But, in our day and age, it is a rare practice, not unheard of, but rare.

                No one needs a warrant to knock on your door.

                  If they enter your place without asking you first, in some states you can legally shoot them.
                  If you got a Rotweiler make the dog growl and lunge at him/her, but keep a good grip of the dog leash.

                    ...no dogs or gates here to keep them out. But I do have a nice 12 guage shotgun handy!
                    I guess after I get all my affairs cleaned up (business wise) then I can file BK and be finished with all of them!

                      ok i mis understood, coming to your door is one thing, they can stand outside my gate all day if they want, i thought you meant they could come inside, which i couldnt understand.

                        Yeah, they can come knock on your door (or gate ) but that's it. Under Arizona law, even after they get a judgment and a Writ of Execution, the sheriff's constable has "no right of entry" into a debtor's home. They rely on voluntary compliance and the best thing to do is to simply not answer the door.
                        The world's simplest C & D Letter:
                        "I demand that you cease and desist from any communication with me."
                        Notice that I never actually mention or acknowledge the debt in my letter.
