    Renting -- going to foreclosure

    I am renting a home from a friend. He is 3 months behind in his mortgage payments and has decided to go to foreclosure, he is gone and I am looking for a new place. He told me in addition to stop paying the mortgage he is behind on the HOA and is not going to pay it anymore either.

    So I am just worried if there is anything the HOA can do to the home besides the bank foreclosure to my stuff? I figure I won't be out of this house for at least another month while I look for a roommate to get an apartment with and I don't want them to come put a lock on the door.

    I don't think any state allows an HOA a right of entry or a lien on personal property located inside a debtor's home.

    Thus, you should not have anything to worry about.

    Honestly...if this person is a "friend", you can stay in the home rent free for probably the next 6 months and even longer. (assuming your friend does not try to evict you for non-payment of rent). The bank probably won't care that you are in the house and is not going to try to collect rent from you. But eventually, the day will come when you have to move. But from a financial point of view, you can probably stay there rent free easily for the next 4-6 months and it is something you should consider talking to your "friend" about.
