    RX copays

    I posted this in the CH 7 forum, but didn't get any response. I'm really worried and could use some suggestions.

    I have a chronic medical condition. I receive my medications through my insurance's mail order RX service. I have to pay before they ship them out. I have allocated enough money to cover my medical into a flex spending account through my employer.
    So here's the question...my mother has agreed to pay for them and I would reimburse her when I was reimbursed. The reimbursement comes as a direct deposit to me. I will be ordering my medication prior to filing and maybe again before my 341, so if how does that look? Would that be a preferential payment? I might be able to get mom to wait until after the 341 before I have to pay her, and I not get reimbursed until after. I'm not trying to hide that money, but since I no longer have the credit cards to put the co-pay on, I'm kinda scre*ed. The amount I am talking about is way over the $600 limit.

    How do I go about this the right way? I will do without my medications before I will suck that much money out of her and not be able to pay her back. Can I just scream??? I getting so tired of all of this. I know I'm not the only one, but geezzzzz gimme a break!!!!!!!!!!! Thanks for letting me vent.

    I'd not go without medicine under any circumstnaces. Techincally, it would likely be peferential payment but, I think you'd have a good totality of circumstances agruement.
    Why not split the payments up? Pay a couple of hundred bucks every few weeks.

      You did not state what medical condition you have......

      But many medicine companies will help supply you with your meds free or charge of at low cost when you become a hardship case...

      Contact your doctors office regarding samples, name of suppliers, etc and see what you can do. Explain the situation to them.

      Have you contacted the local health dept regarding your meds. They may be able to steer you in the right direction for help.

      Even people with insurance coverage often find themselves in the position where they cannot pay for meds.....

        I've tried to receive help in the past, but I made too much at that point to receive any help. I know I won't qualify now because I have a higher income now than then. Last year I spoke with someone about the fact that I had a $200 co-pay on a single RX, and she was I don't know what to tell you, but if it makes you feel any better I spoke with a man who's copay on his single RX went up to $500. If I can afford to live for about 8 months on nothing, I could probably receive disability, but I want to continue to work as long as I can, and frankly I do like to be warm in the winter and I like to eat at least once a day. Oh, I'm ranting again aren't I?

          Since you have not filed yet, discuss this with an attorney and see what he says..... as the medical bills will be a part of your expenses........ and the incoming funds that pays for them should be exempt....

          Yours is a situation where I'm not sure anyone would have an answer except an attorney...

            woohoogirl no way this could turn out to be preferrential anything. just get plenty of receipts, photocopy's signatures whatever for where that money goes.

            its good to see you still have a sense of humor...its the only thing that keeps me going lately.

              Correct, this situation is not a preferential payment issue, its an expense issue.

              Plus, to be preferential, the amount has to be in excess of $600.

                Thanks for all responses. I'm trying to wait out this last round of MRI before I see an attorney (well actually retain one), in hopes that they might go away with my bankruptcy. I've got my fingers crossed, but if they don't then I guess the hopsital will get $10 a month for the rest of my life. LOL I'm in that waiting and pondering stage, and I've thought about everything from every angle known to me. I guess this is my obsession for now. Maybe after I get out of the 60 day club, I can obsess about something else maybe a HUGE savings account....hmmmm that would be nice!!

                  The amount would be close about $1000.00. But if I document the fire out of it, then surely it wouldn't be seen as preferential payment.
