    Please Give Input

    last 6 months income was a negative 100k

    (i am a stock trader who lost money )

    so i file chapter 7 and am looking for a job

    after the 341 i can get any job paying anything, right?

    ALSO... a friend loaned me money to pay rent for 2 months

    is this a factor?

      I wouldn't say that for sure just after the 341 because things can happen between then & the discharge, like audits or objections that makes delays. As ridiculous as that sounds but I would still try to get some income going but maybe not the highest pay until it is all over. If they see you get a job before discharge making 100,000 a year, that is going to raise some questions, I think & might change your chapter 7.

      a factor for what? They will just view that as a debt to your friend & a necessity bill too.

      I think that is more the way I would look at some of it, if it were me. But I am not you, so you have to do what is best for you.

      What does an attorney say about all that?

        The debt to your friend should be included in your filing.
        Trying to hide that fact would be a bad idea.
        If your plan is approved, the debt will be discharged - so legally you won't owe your friend the money, however, as with any creditor, you can chose to pay back the loan, regardless of your discharge.

        I would explain this in advance to your friend, so that they aren't surprised when they get a notice. And let them know you do intend to pay them back.
