    My situation, need advice thanks!

    I have a summons(5k owed) received in person on November 26th, which says in 20 days to appear in court. I went to the lawyer in December 10th for the first time, who was professional, but said there was nothing I can do about it.

    She took my info, and ask questions, then she told me to bring all the documents(bank statements, etc.)

    I am still in information gathering and won't be back to my lawyer until after new year's with all the info.

    I owe about 130k, and she told me the federal trustee might get involve. She told me 70% of the time, cases with high debt, the feds get involved. She says if they don't, I will be truly lucky.

    So about the summons, since I've already passed the deadline - it means I've already defaulted right? It means I will have to pay back the 5K......but what if I still don't have money?

    Judgments from credit card debts are discharged in bk.

        Yes, judgments of this type are discharged in bankruptcy also.

        Also, the US Trustee requested info from us because of the size of our debt. This is normal. We are not being audited, he just wants to make sure there is nothing fraudulent (which there isn't). Our lawyer told us it was normal, we have nothing to hide, so don't worry about it.

        PLEASE NOTE: I am not a lawyer. Bankruptcy may or may not be a best scenario for you. It depends on your situation. You may assume my advice is totally useless. Talk to an experienced bankruptcy attorney (or three) in your jurisdiction for legal advice.
        Chapter 7 Filed - 11/27/07
        Discharged - 2/29/08
        Unsecured Debt Discharged - $162k +/- (small business, personally guaranteed)
        Finally Closed - 3/1/09
