We have 2 trucks. We were going to reaffirm both. Had 341 meeting. Are 2 weeks out before last day of objections. We now have decided not to reaffirm one truck. We owe more than its worth. We havent signed a reaffirmation agreement. The car company did send a letter to lawyer stating we can either sign the agreement or call the 800# to surrender it. Do we have to do this before our objection date is due. Or can we do this after we are discharged? Last date is June 27. Less than two weeks. And if we dont reaffirm does the court find out and relook at our budget seeing now we only have one car payment instead of two even though we will have to get another vechicle soon. Thanks

You should check with you lawyer for state laws around this. In California I could keep my car and not reafffirm as long as i was current on the car. My attorney also said if i want to do this i need to be current at my 341 meeting. The trustee never asked about what was going to happen to the car just if i was current.
I gave the car back to the bank (it was up-side down) but was able to keep it untill my discharge and when i called they even worked with me on pick up and i had a few extra weeks of using the car. Not every bank will be nice about it, it is their car and they may want it ASAP.
