    When to file taxes?

    We are planning on filing BK in March. I don't know for sure yet, but I think we should get a decent tax refund back this year. Last year we got over 3K so I'm thinking it will be somewhere close to that one.

    Should we wait to file our taxes until after the papers for the BK are filed? Will they ask what we expect and then go after it anyways? My atty told me we'd be safe with up to 8K in the bank (yeah, I know it's high, but I specifically asked her and that's what she said). Does that include tax refunds and things? We need the money for a replacement car (nothing crazy, just something that runs, lol), some type of emergency fund, and baby things as we are expecting our second baby in April.

    File your taxes asap and get the refund back *before* you file. Then spend the refund down to what is protected by your exemptions - buy the car, stock up for the baby, buy clothes, and other normal living expenses. Save the receipts in case your trustee wants to know where the refund went.

    Of course, discuss this with your attorney before implementing. It's perfectly fine to plan ahead for bankruptcy regarding taxes and other financial matters - that's the smart thing to do.
