    Do Trustees ever question Child/spousal support?

    I make a lot of money. Well into the 6 figures. My wife and I have seperated, and agreed on $5K a month (Child - $3,500 Spousal - $1,500)

    Unfortunately, I am going to have to file a 13.

    Do the Bankruptcy attorneys and/or trustees have any right at all to question the order of the family court?

    Court ordered child/spousal support is a priority debt per bk reform. Unless a trustee can show some abuse, they'll leave it alone.

      When it come to bankruptcy and your information, Trustees HAVE FULL CONTROL OF EVERYTHING......

      So anything regarding your divorce and child support when it involves YOUR MONEY, he will ask questions about.

      The amounts will have to be court ordered (these he won't bother), but any offerings (from the kindness of your heart) he will seize to help pay your creditors.

      Be prepared for it.... he may ask for divorce papers to prove amount of child support and alimoney....

        We were required to submit copies of the divorce agreement which included CS agreement.

        At the 341 we also had to fill out a child support/family support/alimony form with bio-mom's name/address/phone.
        Filed 07/07, $120k unsecured debt
        Plan: $400 (includes cram down) 60 months
        Brilliant attorney, decent trustee, awesome plan
