    Credit Report Cleanup

    My Chapter 13 case was discharged back on 12/14/07. I am now in the process of cleaning up my credit reports. I ran all three reports last week and see that several creditors have the status of "Charge Off" with pre-petition 30/60/90 day past due showing. When I dispute these, the status should show "Included in Bankruptcy Plan" correct? Also, once the status IIBP, do the pre-petition lates still show or do they go away too? It's all very confusing...

    I am learning that there is a difference between "included" in BK and "discharged" in BK. You will want to be sure to dispute and have it say "discharged" in BK. I am also cleaning up. Doing ok on TU and Ex but Equifax is awful to get anything changed. And progress is slow. This part of the process requires patience and that was never my strongest asset. LOLOL

      When you are discharged, all creditors should report:

      $0 balance due
      $0 payment due
      "IIB" or "Included in Bankrutpcy" or some such notice for the status

      You can NOT have any lates AFTER you file bankruptcy. You can NOT be late on payments after the date of your bankruptcy, so dispute any lates that show up after your bankruptcy filing date.

      Any payments that are late BEFORE your bankruptcy filing date can show up on your credit report as lates. Only payments after your bankruptcy filing date can not be shown as late.
      Chapter 13 Filed "Old Law"
      Filed: 6/2003 Confirmed: 3/2004
      Early pay off sent: 10/05/2007 - 9 months early
      11/16/2007 - Discharged!

        UGH! My credit union didn't "discharge" me on my credit report. Instead they "Charged Off"!!!!

          "charged off" = "still OWED BUT now FORGET/FORGIVEN by lender". To bank/lenders, this is still NEGATIVE/BAD credit!

          And "IIB = Good intention on debtor TRYING to pay-back lender in C13 plan". This is BETTER/POSITIVE credit than charged-off!
