    Increased income = no Chapter 7?

    I had a meeting today with an attorney that only does Chapter 7. He would not touch my case because he says that they will make me do a Chapter 13. I am in a comission only position and was layed off in July. I received my last check in Aug for 8k. I have a new job and made 15k for the rest of '07. I had one good month in Dec(which pays on Jan 31st) for 9300. That totals about 33k for 6 months, under the means test for CA. I am just curious if they look at income for the past 6 months only or since I had one good month, will they think that is the norm. Just currious if anyone has seen this scenario.

    Sounds like that attorney is one you would not want to use anyway. He seems like he doesen't want to work for his money. He wants money for easy cases, likely which the filers could do themselves pro se. Check with some other attorneys in your area. You may even be able to do phone consults if there is an attorney farther away that you would like to interview. Keep in mind you are hiring this person to do a job for you and you are paying your money. They work for you.

    That said, if you keep getting the same answer you may have to decide to persue something other than a 7.

      That is what I thought as soon as we started to talk, which lasted for no more than 5 minutes. I have made another appointment for later this week and may see if I could talk to someone over the phone like you suggested.
