    How can I withdraw a Chapter 13 filing?

    My husband and I filed Chapter 13 bankruptcy 3 months ago to avoid foreclosure or our mortgage. We intended to sell the house all along, but wanted to wait until our son had finished the schoolyear. We now want to withdraw the bankruptcy filing prior to selling our home, and simply pay all our creditors ourselves from the proceeds of the sale. That way, we will not have to wait 1-2 months for the proceeds to be released to us by the trustee, as we need them to obtain our new housing. We are having alot of trouble reaching our lawyer...he is not returning calls. Is there any way that we can file the withdrawl ourselves?? Thanks for your help! -eliza

    I am assuming if filed only three months ago, you haven't had your hearing to confirm the plan? The easiest way out of it, would be, just not to show. If your attorney cannot return calls, maybe you can give him an extra spring in his step by contacting your State Greivance Panel and make a complaint.
