1-2007 My wife and I met with our attorney in Colorado to discuss filing BK, we determined that we could file chapter 7. We were moving to NE in Feb, so we needed to get a move on things...Needless to say we just finished, what a long drawn out dramatic process that end well.
2-2007 We moved to NE and started to settle in, the stress is building daily. I had a business in CO that had failed with the construction decline over the last couple years, adding in our personal debt and business debt were cleary upside down.
5-2007 Finally get our paper work all complete and sent to the attorney. Expecting to file chapter 7, and to no avail we get called about 10 days later saying we cannot file 7 anymore due to income earned over the last 4.5 months offset the means test..
UGH
6-2007 we filed chapter 13, we were looking at $750 a month on the 5 year plan, we had accepted the delay as our own mistake which would cost us.
8-2007 341 meeting completed and expecting to hear back all the info about the payment plan details. We have made 2 payments already for june and july. Then we get a call from our attorney, he F'd up and filed our paystubs on the wrong case #. Our case was DISMISSED!!!!!!!!!!
9-2007 So we start discussing what has to happen again, after 2 days we find out that we can offset the business debt over the personal debt which means we can FILE CHAPTER 7!!!
11-30-2007 Meeting of Creditors
Stipulation of Tax Return letter signed, meaning they get 75% of our return if any issued.
1-29-2008 DISCHARGE
Awaitng notice of closing.
All in all this has been the WORST TIME of OUR LIVES.... THE MOST STRESSFULL NO DOUBT.
My wife still is stressed out and cannot relax.
I am de-stressing slowly as well...
