    Can you stop a bankruptcy once you file?

    I filed bankruptcy in June of 07 and it is still not fiished/been accepted by the court. It is 100% bankruptcy and I have been making payments since July 2007. I am working with my mortgage company so they don't foreclose. I am now able to afford the payments and don't want to go through with the bk. Any experience on this matter? Thanks.

    Once you file, it is on your credit record for 7-10 years. Why hasnt it been confirmed yet?

      I know it is on credit but that is not my question.
      Has not be confirmed because has not gone to court until next month.

        You can file a motion to dismiss your Ch 13.If you have other creditors, they will likely pursue those accounts and add interest and fees.
        Filed CH7 - 10/13/05;
        341 Meetings: 11/28/05, 3/20/06, 12/4/07 (3d time's a charm!)
        Converted: 2/15/06 (to CH13), 10/15/07 (Back to CH7)
        DISCHARGED: 2/15/08

          Sounds like you are in a chapter 13; so you yes, you can voluntarily dismiss the case no questions asked. However, you may really want to crunch the numbers on this, 90% of the time, it is better in the long run for a person to stay in their chapter 13 to the end, then dismiss it.

          Ask your self, could you be OUT of debt in 5 years if you dismissed your case (be realistic), if the answer is no, you should probably stay in the chapter 13.

            Thanks for the help. Also, I have made an agreement with my mortgage company, they are going to lower my payment it is going to be 3k a month.( I have not made a payment since a month before I filed my bk.)My payment to the trustee is $800.00 a month. Can I get my payment to the trustee lowered now that I have a mortgage pmt?

              If your budget has changed, you can file an amended plan to show the difference.
