    I want to speed up my foreclosure

    Here is the deal:

    Foreclosure was started in November 2007

    I filed Ch 7 in December, with intent to surrender house

    Automatic Stay put the foreclosure on hold

    Mid-January mortgage company got the relief from stay

    Foreclosure STILL has not restarted

    1st mortgage is with Countrywide, and there is a 2nd also with Countrywide. Additionally, the HOA has a lien for past due assessments. All of this is included in the BK filing.

    I really want to move on with my life and get rid of the house, but I also am not interested in abandoning it unless I can also abandon ALL legal and financial responsibility.

    I am calling Countrywide's attorneys weekly but they just keep telling me they havent heard anything yet regarding restarting the foreclosure. When I called Countrywide directly, they basically just gave me the run around.

    So the question is, is there any way to speed this up? I'm in Colorado, if it makes a difference.

    I'm pretty sure I already know the answer, but ya never know...

    Why bother speeding it up, simply live in the home rent free.

      Yes I know, but I have reasons for wanting to move on.

        Then move, but write CW a letter telling them that you are moving and will sign a quit-claim deed.

          Well more than 6 months later, the foreclosure FINALLY took place yesterday. I am so glad to have that behind me, even more so than the BK.

            In Ohio

            We were in foreclosure and filed Chapter 13, still hanging on to the idea of keeping the house. We couldn't afford it and it was one thing after another needing repaired (now the toilets are leaking at the valves and it looks like the seals need replaced). We got a letter dated 9/18 (my birthday) stating the stay had been lifted. I noticed on the chapter 13 site that where it had said that we were going to pay Countrywide almost $9000 it now states $5900. That is the amount it also shows that we have already paid in to them. That means the plan would be done this time next year. I don't know what happens once they sale the house and are negative on the loan.(we owe 79,000 and appraisal was 75,000) . At any rate, we are prepared. On 10/15 we sign the lease for an apartment (at almost $500 less a month than mortgage). I am curious about our townhome though. I know we have to keep insurance up on it. HOA is attempting foreclosure because of dues(which we have intention of paying), which I realize we are still responsible for. But other than that what is required? Do we have to keep electric on here? What about the keys? Should I leave them in the HOA office? And I don't want to wait around for them to list it for sale to move because I don't want to be stressed and in a hurry to try to find somewhere to move. The apartments we are moving to are nice. We were upfront and told them we are in foreclosure and have filed bankruptcy, and that we were not using a co-signer. They just required 1 month deposit and the first month is free. Who knows if we would be that fortunate in the future. Ok i am done rambling now. I'm wondering how long this process will take.

              My foreclosure with Countrywide started in Nov 07, also. Still nothing. I agree that I wish they would foreclose and get on with it. I moved out 6 months ago.

                Wells Fargo just got the stay lifted on mine. I am in PA it says it takes 265 days for the foreclosure. We want to get out of here too but i am not willing as long as I have financial responsibility. My lawyer said I can look forward to April before they get it done. the law firm for the mortgage company screwed the paper work up on the motion to lift the stay so I am not sure how long i will be here. It is nice liveing rent free.
