Angelina, you must file as soon as humanly possible. This won't stop the case from going before the judge, but the sooner you act, the sooner you can put a halt to the judgment. You should go through an attorney because you are going to have a judgment on your credit and you will need a special motion filed in order to extinguish the judgment. That's why I say the sooner the better. You may have to face wage garnishent until you can afford to file BK. But when you file, and your attorney files the proper motion, you won't have wage garnishment any longer.

I would go in front of the judge on the day of your court hearing, if I were you. I don't know if it works, but maybe if you tell him you are about to file BK he will rule in your favor and you won't have any judgments at all.

The worst thing you can do is ignore it.

    Tell us what happens.

I had this happen to me to, and I was able to get my papers in the day before the judgement hearing!
