Waiting to file?

Hi Everyone,

I'm spending lots of time here trying to read and educate myself.

For a few reasons, we want to wait 9-12 months to file. In short, I believe we will qualify for a chapter 7 at that time, and right now, I think we would only qualify for a chapter 13.

Please, please tell me it isn't wrong to wait those extra months so that we qualify for the chapter 7.

(And I really *am* sleepless. I spent at least two hours here in the middle of the night trying to read and understand everything.)

Personally, I believe that anything that can get you into a Chapter 7 is worth doing.
Many here have waited some period of time to file. Sometimes to put distance between filing and cc use others, to show a lower median income,etc. Do what workd for you.

talking to attorneys might help

I can understand the worrying. I think you can talk to an attorney about this. Ask this question of them and present the details! You can meet for a consultation with an attorney for free. You can pose these questions there. And you can go to 3 or 4 or 5 attorneys and get a variety of perspectives.
Attorneys can't use that information to "hurt" you. So you are not putting yourself in jeopardy to ask about your "scenario."
In fact, the attorneys will typically give you the legal logic (assuming there is one) for what you want to do. And/or they'll tell you the legal weakness of your plan.
I found going to attorneys to get things started a great way to burn off the nervous energy and anxiety I was feeling. It's something practical to do, and it makes the whole process more real and concrete and "normal." At least it did for me.
