Recent 341 people - stimulus mentioned?

I looked in the stimulus thread and didn't see much - lots of people have been having their meetings and I wondered if the checks have been mentioned?

I had my 341 last week and the trustee never mentioned it. I think at this point with anyone having a 341 in the near future the trustee would bring it up if he had his sights set on it.

I read about a month ago on here that someone got a letter from their trustee about the stimulus saying that he wanted that person to turn over their check as soon as they got it.

It's really all up to individual districts and the personalities of individual trustees.

The person before us mentioned the stimulus checks to the trustee... he quickly said he doesn't want to know anything about it. It was never mentioned to us.

That has got to be the stupidest, most boneheaded, moronic thing anyone could do at a 341. For pete's sake people, the trustee is on the side of the creditors, he is not our friend, our lawyer's friend or there for any reason except to take everything he can.

He (or she) doesn't need our help at the 341; if they don't bring up the stimulus then keep your mouth shut!

I have read several posts about people having to turn them over - that's kind of what made me ask in this thread.

I probably would have been stupid enough to bring up my stimulus check too! Glad you said that! Sometimes I can just be naive and say the wrong thing.

So, I guess if it isn't mentioned in the 341 then I should probably assume I keep it.

I'm glad to hear some are being kept. My attorney thinks I should be able to keep mine - he said he hadn't seen any being asked for but that was back when I signed my filing.

My bankruptcy lawyer didn't have the first clue about what was going to happen with the stimulus check when I asked him. Not exactly comforting, but whatever. It didn't come up at my 341 - there we had the sense to keep our mouths shut and spoke only when spoken to.

Judging by the laws that created the stimulus payment, it appears to be a refund of 2008 taxes. Therefore the trustee should only be entitled to however much of it was earned between January 1 and the date of the BK filing. For example I would have to give up 42/366 of it because I filed on 2/12. But since it wasn't even listed as an asset on my BK, nothing is coming of it so AFAIK I guess we get to keep our $1800 when it comes next month. Not that the $206 would break me but I'm much happier to keep it........

I wondered this too. When I asked my lawyer, she said that she thought we would be able to keep it. Ours will only be $1800 and will be used entirely for my child's private schooling tuiton....I sincerely hope we get to keep it!

I'll have to remember to keep my mouth shut at my 341!

I will keep my mouth shut too. We file either the end of this month of first of next. Our rebate should be deposited on May 2nd. I wonder if we should either file before that or after that? Wonder which would be better. At this point who knows right? Well this should be very interesting. To me, since it suppose to stimulate the economy, it should be hands off in a BK anyway.

Ours should be about $1800 which is a lot of money to us. We could do so much good with that, fix my car, and maybe even buy a new water heater. But time will tell. I wonder if we file after that comes and use the money for those repairs and keep receipts if that would be ok.

I'll let you know how my 341 goes - it's next Wednesday and I'm also in IN. Of course, we won't have the same trustee though so maybe it doesn't matter.

Good Luck and that did go fast, be sure to let me know how it goes. That will be another hurdle behind you, then it's just the wait and be discharged and closed!
