    Question Regarding a Judgment After Ch7

    I filed for Ch7 a month ago and had my meeting a week ago. The whole reason why I decided to file Ch7 was because I received a judgment and my bank account was garnished in Jan. During my creditors meeting, the trustee told me that it may be possible for me to get my money back. If so, does any one know what steps I need to take to do so?

        Okay, that is known as filing Pro Se.

        Hmm. As far as the second part...I would suggest calling the BK court, the secretary there should hopefully be able to point you in the right direction. Just explain what the Trustee told you, and even if they can't give you an immediate answer, hopefully they can check with the trustee and have you call them back or even they can call you back with some info.

        Hopefully someone else will chime in, but the first place I'd start is with calling the BK court.

          Some local courts are very helpful to pro se filers. Others won't give you the time of day. Hopefully your local court will be a helpful one.

          Realize that even with a helpful court all you will get is a suggestion of which form to use. Only a lawyer is allowed to give you legal advice - it's the law in all 50 states. Taking a creditor to court to get garnished money back isn't a pro se project.

          If you still can't afford a few hundred dollars for a bankruptcy lawyer to help you, then see if you have a Legal Aid office in your area - they should be able to help you and will charge only what you can afford. Good luck!
