I am sure this has been asked but I am about to file chapter 7 since I am being threatened with law suits from an attorney in my state for a balance of almost 5,000 and I believe it will happen since the debt is over 2 years old and I havent tried to work out anything.
But if I were to be sued there is no way I would be able to afford a garnishment as I am the only money maker to support myself, wife, and baby. So I had to cash out 1,000 of my 401K to be able to pay the attorneys fees. We are not filing together but just me alone. Now my wife since she worked partly last year she is getting 600 for the stimulus plan and I am getting 600. I know they cant touch her money since we did not file taxes together. I filed single and 0. But my question is, are the trustees taking the stimulus checks or letting people have them. I would use mine to stock up on baby food, clothes, diapers and other supplies and probably treat me and her to dinner and a movie.
If I knew for sure they wouldnt take it I would file now because I want to buy a house in the future but I dont want to file now and loose that money.
