    Grace Period for mortgage payments after filing Question

    This may seem like a stupid question but it just dawned on me that our mortgage payment due date says the 1st. I never pay it until the 4th because I receive survivor benefits through Social Security for two of my children on the 3rd. I have done it this way for 6 years.
    If after we are filed will I be okay to still pay on the 4th? I just read a thread where someone posted about forclosure starting if your just 1 day late. The mortgage is through CitiMortgage and I have always paid online. There is no late fee unless you pay after the 10th. So would the 10th technically be considered late as far as forclosure ..etc..

    Honestly, most banks do not change their "system" of accepting payments even after you file BK. Thus, their computer systems still recognize the grace period and do not flag your account as late so long as the payment is received and cleared within the grace period.

      Glad I saw this post, our payment is due the 1st, but setting up for auto withdraw, which I realize will stop once we file we always had it taken out on the 15th (grace period). I am hoping to redo this date once we file and pay closer to the 1st. I suppose when we file, I will contact the Mort co and ask about making the payment and on what date it is considered late. We have always used the grace period (9yrs) and it shows as being paid on time for the entire time and I wouldn't want it to show being late suddenly.

        As long as they receive the payment before the close of the grace period, you are fine. Technically and contractually-wise, your payment is due and owing on the 1st as agreed upon when you signed your mortgage contract. However, most mortgages do have a grace period (usually 10 days) after the due date for them to receive your payment without a late fee; after that date your morgage payment includes a late fee and that is usually listed on your payment stub, online or in your mortgage paperwork. At the 30 day mark, if the payment is not received, you are 30 days late which will be listed on your credit reports and is just a place you don't want to be at this point. When you hit that point, you will be under observation and if you will receive letters/calls from the mortgagor because you are in Breach of Contract and foreclosure proceedings can be implemented if you do not pay.

        Always try to make the payment on or before the due date (1st) but if that is not possible, ensure you continue to get it in as close as possible to the due date but do not go beyond the grace period. This is best for you credit wise and is always a good habit to have to protect your credit.

          All my adult life I knew payments made after 30 days would get reported to the credit bureaus as late payments, but in my mind I always thought of that as meaning as long as they received payment before the next due date then you were fine. But now I realize that probably isn't the case since some months of course have 31 days in them. Duh!
          04/04/08- Notice of deficiency balance due from a repo. 04/18/08- Fico scores w/repo listed: EXP 624, TRAN 610, EQU 610. 04/19/08- Found this forum. 04/24/08- Retained attorney for a chapter 7, filing singly. 5/5/08- Turned in bk paperwork to atty. 5/27/08- Date set for reviewing paperwork.
