If you don't pay, they send it to collections. I think also that if I don't pay, it will go on my son's credit report, or at least that is what the probabation officer said. Doesn't seem right that it could come back on my son, being a kid and all.
I don't know if it is state by state or no, I live in WA.
It could turn out to be a fairly large amount of money.
To attempt to answer the question, gut instinct tells me that the debt is probably dischargeable. You will want to review section 523 of the BK code (exceptions to discharge). I am hard pressed to find an area within that section that neatly fits this fee, so I would say you probably CAN discharge the debt.
But a little more background on how this charge works would be helpful. Is it administrative, was it ordered by a judge, what are the consequences if you don't pay it, are there exceptions to paying it the parents are in financial hardship. (I have a hard time believing that this fee is collected even 25% of the time).
