    What if I foreclose after the Chapter 13 plan

    If I stop making payments on my home after a Chapter 13 plan is set up. Assuming I pay the mortgage on my own, not part of the 13 payment plan. I would keep making the 13 payments, just default on the home loan. After the house goes back to the bank, will the trustee want to go over my income schedule and up my payments. Right now my mtg is higher than the rent credit.

    I would think that the Trustee would consider that if you no longer have that mortgage payment it would be considered an increase in disposable income, minus whatever rent you have to pay. Maybe if your rent is in the same range as your mortgage payment then it might not be an issue. If it is less then Trustee might want the difference if it is significant... You have to let the Trustee know one way or the other or you might risk future problems for sure.
