    Divorce / Bankruptcy

    Going through a rough divorce. Have been sleeping on couches, floors, etc for the past 6 months in an effort to continue paying credit cards, attorney bills, etc.

    Its getting to the point that I need to get a place for my son and I to live -- finally got roughly 40% custody of him a few weeks ago but can't continue living like a vagabond.

    So, here's my question. A friend has offered to rent me their 2BR condo for $1500/mo (under IRS limit for SF Bay Area). Solves my housing problem, but would mean that I could no longer pay my credit card bills.

    How will the trustee view this...rented apartment in July, stopped paying bills, filed for bankruptcy.

    I really am not trying to abuse the system, but face a situation in which I can either provide housing for my son and me or continue paying the bills. Fear is that I may lose custody if I can't provide a stable place for him to live.

    Appreciate any feedback.

    I am sure any trustee would be sympathetic to your situation and there should not be an issue. However, since divorce and bankruptcy at the same time can be extremely complicated and ridden with financial/emotional issues, I would suggest consulting with a BK attorney (most give free consultations) and he/she can give you a better handle on your situation as to what you can and cannot do in the state in which you reside.
