We filed ch 13 on Nov. 1st 2007 then converted to ch 7 May 1st 2008. During the months we thought we were going to be in the 13 we paid a payment to the trustee to pay the secured loans we were going to keep.I just pulled my credit report and noticed our auto loan is the only one not showing us in a BK and they reported 30 days late during the month of Feb when we were paying the trustee. I know this is nothing compared to the rest of the negative reporting due to the BK but I am wondering if they can report me as late during the BK when I was actually making the payment but it was the trustee that paid the lender late. I want to keep any good credit I can if possible through this process!

You are not going to keep good credit in a bk of any kind. When you are through it, you will have to build it up again. The good side is, you cannot bk for seven years so you will be getting plenty of credit card offers in your junk mail. Even a secured car loan (but at a higher interest rate) could be gotten as they can get the car back and sue you for the deficiency. 'HubIf I knew it all, would I be here?? What is really strange is the report is showing only 9 negative items and I have about 20 accts. included in the BK.Most of them included in the BK are not there. Right now 44 accts show in good standing! I had great credit until I decided to file and stopped paying the cc's. I know it is really irrelavant at this point with the BK on there but my mortgages are showing "petition for ch 7 BK/never late" so my auto loan should show the same I would think?

My husbands ex changed her mind and filed a $29,000 back child support claim against us after saying she was not going to.He was laid off his job after 9/11 and was paying her a reduced amount for some time while trying to get a job. She actually ended up helping us out by changing her mind and filing this claim because we are well over median but with this claim(which takes priority) put us in a ch 7 instead of a 13.Rather pay her 29 grand than 70 grand to the credit cards and not be on a 5 year payment plan with the trustee.
