    Venting

    The husband and I filed Ch. 13 in Dec. 2006. Our payments have us barely getting by some weeks. We are so tight we squeak!

    Our lawyer just filed the paperwork to have our payments reduced so we can take out a loan on hubby's 401K (that will be paid weekly out of his check) to have $3000 worth of dental work for him.

    When we heard about the stimulus checks, we were totally doubtful that we would get one. Our lawyer said the bankruptcy courts here in GA were not requesting them though. Just talked to the IRS today and because we filed Ch 13 they say it is on hold and can't tell me IF or WHEN we will get it. I am really upset. We REALLY could have used that $1500. The transmission in my car is acting up and we were going to put it in the shop before it got way worse.

    I thought we did the right thing by filing 13. We owed the money and I did not feel right about filing 7 and writing it all off. I feel like we are constantly battling how we are going to pay for medical, dental, and car problems when they come up. It's been a year and a half into the plan, and on days like this I have NO idea how we can keep doing this for 3.5 more.

    You filed C13 in order to retain your assets, right?

    I think it is great you can have your attorney file papers to lower your payment. I hope he isn't going to charge you more for that service like mine did when he had to file something that wasn't done in the beginning. My total fee to him was $3000.00

    As for the "bush check" unless you are also paying back taxes to the IRS, I don't see a reason for the delay. I got mine and used it to payoff my C13. (thanks bush)

    Yes it is a long climb out of the C13 valley but IF you think of that payment as just that---like a car loan---it does help mentally.

      Could you have filed a 7 if you wanted to or are you holding on to property? I don't think you get a choice if you have property you want to keep.
