    707 B (2) is

means test attempt to dismiss right?

Pacer now shows a statement of abuse for 707 b 2. Of course my lawyer is "making calls back as soon as possible" so therefore I have to ck myself in the mean itme or I will go crazy.

THey are attempting to convert or dismiss based on means test correct?

Correct. That flag is there to prevent auto-discharge and you will probably see the flag "MEANSYES" also.

Ok thanks. I can't wait to see where our extra money is coming from and what real expenses we aren't allowed.

I guess I really need to submit my expenses not included now.

Yes, if the UST wants to go through your petition with a fine tooth comb, you might as well do the same. Make sure you're giving yourself the most recent IRS standards (they were updated on Mar. 17 - our lawyer missed this). Add in every possible expense you can think of... Just be sure you have receipts or a calculation written up. One thing you should be aware of is that if you received a large tax refund the UST will try to include this as income on the means test. They may also use it to adjust your tax expense on the means test and schedules I/J. If you have a 401K contribution listed as an expense, they may be excluding that too. You can expect any expenses lying in grey areas to be used to make it look like you have more disposable income. It truly is like a poker game and you are being pressured to fold. It's nothing personal - the UST is simply doing their job.

Seems like taxes are something that trip up a few people. You want to make sure that you are using actual tax obligation and not just withholding from your pay checks, particularly if you receive a large refund every year.
