    I'm confused

    If I am served and I file it is basically a race?

    Don't I have a mere 30 days to answer to avoid a default?

    If I get served today and I file a week later doesn't the default win before the filing?

    Is a default set aside in BK?

    Very fortunate in the grand scheme of things but have learned my lesson.

    Filed 12/15/08, 341 1/12/09, Cont to 2/12/09, cont to 3/12/09, cont to 4/15/09, cont to 5/11/09, cont to 6/02/09. Discharged 9/16/09, Closed 10/23/09

    If they served you the initial papers.

    You would have 20-30 days to respond to the petition in writing depending on jurisdiction (or in person)

    Having this judgment does them nothing. All it establishes is the fact that you owe the debt.

    The debt can still be released. I filed after the initial 30 days to respond. Nothing happened to me though cause I listed the case and debt .

    So long as it is not for unpaid child support or alimony then yes it would be set aside
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.
