How long will it take???

My wife and I will be filing for bk7 soon. We met with our atty for the first time last Thursday and will finsh all the paperwork tonight. Yesterday was our first late CC payment ever. I went through and deleted the bank acct. info on their websites so they can't try to take money out.

So after giving all the requested info to the atty, what is the typical time period before the 341 meeting? Also, how long before these CC companies start calling me? How about the automatic stay, when does that go into effect? I know there may not be a definite answer, but averages are nice.

First the calls may start as soon as your late. How you handle those is up to you. Some answer the calls some don't. We avoided the calls for about 2 months, then once we got our nerve up, we answered and referred all calls to our attorney. Little by little the calls stopped. We hadn't filed yet, but we had paid our attorney in full. That seemed to end those calls.

341 seems to depend on where you live. Most seem to have theirs within 1 month. Automatic stay is the day you file or shortly there after, if anyone calls once your are filed, give them your case number that will stop the calls.

Good job on removing your bank accts from your cc. Very smart. Remember once you are filed they can not send paper statements and will close online access to accts if you have any debts you intend to keep, like cars or house. Keep your statements to use to keep making your payments, even if you copy them and send them the copy.

Try not to worry too much about the phone calls, all we talked to where nice, none harrassed us like the did before we decided to file. It honestly wasn't bad.

My 341 was scheduled 34 days after filing.

If you get any calls, just refer them to your attorney.

I think your creditors get notified as soon as you file and I think the calls will stop there and then. Basically I don't think you're gonna get many calls if your lawyer is going to file so quickly.

We filed on Dec. 28, 2007, and our 341 was Feb. 7, 2008.

We stopped paying the cc in mid May and started receiving calls about 2 weeks later. We answered the calls are referred them to our attorney. Don't answer any of their questions, just give them your attorney's name and number.

Gosh, you are getting the ball rolling pretty fast! Make sure you take the time to fill out your expenses properly just in case you are "push" into a ch 13.

I just filed yesterday (July 14) and my 341 is scheduled for Aug 21. That's less than 30 days away. I'm in Reno.
