    Student Loans / Hardship?

    Has anyone under the newer bk laws had student loans discharged? It appears there is verbage if they are an undue hardship they can be discharged. What does that mean? What do you have to prove?

    Basically, you have to prove that for the foreseeable future you will not have the ability to both pay your necessary living expenses and your student loans.

    Essentially, unless you are disable and unable to work, you cannot get student loans discharged.

      I too looked into this as my husbands student loans are crazy. Basically what I read said that the courts side with the loan agencies and you must be totally disabled and unable to ANY kind of work forever to even attempt to claim undue hardship.

        I remember seeing a thread from someone who said they were declared completely and permanently disabled and *still* couldn't get their student loan debt discharged. If you find an attorney who can do it, let me know because I'd sure like to get rid of that $105K debt that will still be choking the life out of me after discharge!!

          I want to pay my student loans, but it just seems some still "claim" you can and I was curious
