    filing date

    im filing chap 13, the lawyer that is handling my case said originally the case would be filed on 7/11/08. i called today and the secretary said it wasn't filed yet, im concerned about my paycheck being electronic deposited in friday that will make me go over the exemption that is allowed in my state. any one have ideas what i can do with the money in such a short period of time,since it may be filed on friday. can i w/d the money and not be scrutinized by the trustee. the office help at lawyers office are not being very helpful with the date of actual filing to help my matter.

    You can stock up on groceries, household goods, necessities... pay some bills in advance (rent, utilities, etc.). I took out a large amount of cash and was prepared to explain that it was for groceries, gas, clothing and necessities for the month. It is not unusual for someone who is going through BK to switch to living on cash to control spending.

      Contact your employer REAL FAST - and get them to issue you a paper check. Just explain that you closed your bank account.

          thanks again everyone for the help. my paycheck usually posts on a friday, and as i mentioned the filing date may be friday. If i make a large w/d on friday and does the money have to be spent on same day or can i use it the next day or so? also the lawyer mentioned about my first payment to repay, can i use some of this money for the payment?

            No, you can use it over several days or even weeks, just make sure you keep receipts and all that type of thing to justify where it went, like Help! suggested. And certainly you can use some of it to pay your lawyer.

              Your lawyer can file right now if he is willing as he no doubt has PACER and can upload as well as get you your case number immediatly. You no service from lawyers office is not a new subject here. Insist on this and before Friday, you have it made. Otherwise, all the above is good advice. 'Hub
