    tomorrow is the big day

    Hi everybody, well tomorrow is the big day we go to talk to the attorney, BUT they called to confirm and I asked her what should i bring and she said Oh nothing its just a consultation. What the hell is he going to tell me without showing my paperwork? What questions should I ask? Is he going to tell me what chapter i can file or is it just to tell me what he is going to charge??

    HHMMMMMMmmmmmm, I would say, that day should not cost you anything. He probably wishes to interview you as to what you will need to bring and what costs will be incurred as to what you wish to file. I hope you can go 7 as it is less expensive I have heard, and gets you a clean start. NOW, stop worrying. That will come later when we all will again say, "STOP WORRYING"!!!!! 'Hub

      You will be asked to fill out an intake sheet, where they want the basics; how much you earn, what do you own, what do you owe etc. It is not anything critical at this stage, the attorney will then be able to determine waht chapter is most likely the best for you to file and then based on how much debt he/she is getting rid of and how much you earn, will help him/her to decide how much to charge you. What people don't realize is BK is sales just like everything else. When I meet with a new client, I have to first get them to trust me, believe that I can do the best job for them(which I can) and then based on all that and the other factors I mentioned, I tell them how much it is.

        Hi there Suzy,

        Just bring a list of questions you would like to ask him (you have that, right?) and have a good idea of your expenses (writing down would be fine too). We weren't asked to bring anything either but I had a list of our monthly expenses and our take home pay.

          Same here. I went ahead and took paystubs, tax papers for the last 3 years, deed for our property, car titles, our attorney thought I was nuts I'm sure! Oh well I was like way over prepared and he didn't tell us to bring a thing. Make sure to ask questions.

          Good luck and make sure this attorney makes you feel at ease, if not meet with others. Oh and because I knew we would be dealing with the paralegal mostly, I made sure I liked her too!

            Thanks everyone. I did make up atleast 15 questions. I have bank statements, 3 paystubs, a list of all my monthly expenses etc. I will probably be well prepared cause i have read & read on this website and all you nice people gave me alot of ideas. I will let you know how it goes...

              At our first consult we just spoke with the attorney about what chapter we would file (chapter 13 in our case). He gave us a huge packet to fill out and return at a later date. This is when we brought six months of bank statements from every accout we had open (mandatory), six months of pay stubs (mandatory), documentation showing what we owed and to who, identification, and so on. Our stack was pretty big. It helped that we were super organized and had everything they asked for on the checklist. We met with a paralegal at the next meeting who went over things with us. At this point we had paid in full so we were waiting for them to review and to file. It took us over three weeks to get a case number. Now we are waiting for the 321 date to be issued and for our information to be sent by the courts to the creditors. We still receive calls but now when they call we simply give them the case number and our lawyers's number. I found that when I answered before we had the case number they did not care. The case number makes all the difference in the world. We owe our first payment by mid August.

                My attorney charges nearly DOUBLE to file for a Ch 7...
